What roles are involved in a data protection service?

What is the data protection service?

Personal data is considered to be any information that allows a person to be identified. Either by your ID, your telephone number, your address, etc.

Given their importance and to guarantee rights, these activities are regulated by Organic Law 3/2018, of December 5 (Organic Law on Data Protection and guarantee of digital rights or LOPD, by its Spanish acronym) and Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27 (General Data Protection Regulation or GDPR).

The processing of this information is sensitive and failure to comply with the obligations regarding its protection can put at risk the continuity of a company (at least, it leads to facing severe economic sanctions). Therefore, data and its management is a great bet for the future in all bets.

Who is “The Responsible” for Data Processing?

As its name suggests, the Responsible is the natural or legal person (whether public or private) who has the primary responsibility for ensuring compliance with the regulations.

This figure has the mission of obtaining the consent of people to proceed with the processing of their personal data. Undoubtedly, a key role with a lot of future work in the business world in the coming years.

Who is the Data Protection Service Officer?

The Data Protection Service Officer is the figure that guarantees that personal data is not used for a purpose other than that established by the Responsible.

The Officer is responsible for ensuring the security of the data and, if it produces any type of incident, inform the Responsible immediately. That there is a fluid communication between the Responsible and the Manager will be essential for the future of any company.

What is the Data Protection Delegate?

For the data protection service to be adequate, it is necessary to acquire a proactive attitude. That is, it is not enough to comply with legal obligations, but you must also be diligent in this matter.

Since schools handle sensitive data, the Regulation establishes the need to appoint a Data Protection Delegate. 

The functions of the Data Protection Delegate are as follows:

  • Inform, advise and supervise compliance with data protection regulations.
  • Resolve claims that may arise.
  • To be an interlocutor between the interested parties and the Spanish Agency for Data Protection.

In short, all doubts that may arise about this matter will be transferred to this figure. In this way, the data protection service in educational centers is completed.
